Tracy Morgan Sues Walmart for Truck Accident

Comedian Tracy Morgan has filed a lawsuit against Walmart following last month’s accident on the New Jersey Turnpike that severely injured Morgan and killed comedian James McNair. The lawsuit was filed this past Thursday.

The accident was caused when a Walmart truck driven by Kevin Roper crashed into the back of Morgan’s limo van. Morgan’s lawsuit alleges Walmart is partly at fault for the auto accident. According to an NYTimes.com story, Morgan’s lawsuit alleges that Walmart is responsible for negligence in the ownership and operation of the truck, and that this negligence significantly contributed to causing the accident.

At the same time, an ongoing criminal case has been brought against the driver, who is said to have been awake for more than 24 consecutive hours before the wreck. The driver is charged with vehicular homicide and he has pleaded not guilty to all charges.

Morgan’s lawsuit is seeking punitive and compensatory damages, as well as a jury trial. The suit says that Morgan and two other comedians injured in the truck accident have been unable to work as a result of their injuries, and may even have permanent disabilities as a result of the crash.
